Who owns trader data when I use a white-label provider?
Quick answer
Typically the firm owns its customer data and the provider processes it on the firm's behalf, but this depends on the contract. Check data ownership, export rights, how long data is kept after you leave, and whether the provider can use your data for its own purposes such as marketing to your traders.
Detailed answer
What to look for in the agreement:
- Ownership: you own your traders' data.
- Processing role: the provider processes data for you, with a data processing agreement.
- Export: you can export accounts, trades and trader records.
- Retention and deletion: what happens after termination.
- Non-solicitation: the provider will not market to your traders.
On PropExecutor, traders have no account with PropExecutor itself and no relationship with it; the terms state that everything between your firm and your traders is yours. The platform stores only a name and email per trader plus trading data, and the API gives you full account reports.
Keep your own copy
Even with good contract terms, keep trader records, purchases and KYC results in your own systems.
Check processing locations
Ask where data is stored and processed, and whether sub-processors are used, so your own privacy notice can describe it accurately.
